🌐 EB-1: Green Card for Exceptional Professionals
The EB-1 visa is a U.S. immigrant visa designed for individuals who have demonstrated extraordinary ability in their field—be it science, arts, education, business, or athletics—and wish to continue their work in the United States.
This visa category is ideal for professionals with a strong record of achievements and national or international recognition. The EB-1 visa has three main categories.
🎯 EB-1A – Individuals with Extraordinary Ability
For those who have achieved national or international acclaim in fields such as science, arts, education, business, or athletics. Notably, this category allows for self-petitioning without the need for employer sponsorship.
🛂 Who Qualifies for the EB-1A Visa?
To qualify for an EB-1A visa, applicants must provide evidence of sustained national or international acclaim and demonstrate that their presence will substantially benefit the U.S. There are two pathways to prove eligibility.
Path 1: Major Internationally Recognized Award
If you have received a significant, internationally recognized award—such as a Nobel Prize, Olympic Medal, or Pulitzer Prize—you may qualify for the EB-1A visa based on this achievement alone.
Path 2: Meet at Least 3 of the Following 10 Criteria
If you haven't received a major international award, you can still qualify by providing evidence that you meet at least three of the following ten criteria:
-
Awards: Receipt of lesser nationally or internationally recognized prizes or awards for excellence.
-
Memberships: Membership in associations that require outstanding achievements of their members.
-
Published Material: Published material about you in professional or major trade publications or other major media.
-
Judging: Participation as a judge of the work of others in the same or a related field.
-
Original Contributions: Original contributions of major significance to your field.
-
Authorship: Authorship of scholarly articles in professional or major trade publications or other major media.
-
Exhibitions: Display of your work at artistic exhibitions or showcases.
-
Leading Role: Performance in a leading or critical role for distinguished organizations.
-
High Salary: Commanding a high salary or other significantly high remuneration in relation to others in the field.
-
Commercial Success: Commercial successes in the performing arts.
Additionally, if certain criteria do not directly apply to your occupation, you may submit comparable evidence to establish your eligibility. This flexibility is particularly beneficial for professionals in emerging fields or unique roles.
🎯 EB-1B – Outstanding Professors and Researchers
Targeted at academics recognized internationally for their exceptional contributions in a specific field. Requires a permanent job offer from a U.S. employer.
🎓 Who Qualifies for the EB-1B Visa?
To qualify for the EB-1B visa, the applicant must demonstrate international recognition for being outstanding in a specific academic field. In addition, they must have at least three years of experience in teaching or conducting research in that field. A permanent job offer is also required from a U.S. employer for a position that involves teaching or research.
In addition, applicants must present clear evidence of their exceptional standing in their academic field. Specifically, you must satisfy at least two of the six criteria established by USCIS, which help demonstrate your international recognition and professional impact. These criteria include:
-
Receipt of major prizes or awards for outstanding achievement
-
Membership in associations that require outstanding achievement
-
Published material about your work in professional publications
-
Participation as a judge of the work of others in the same or allied field
-
Original scientific or scholarly contributions of major significance
-
Authorship of scholarly books or articles in academic journals with international circulation
🎯 EB-1C – Multinational Executives and Managers
Designed for executives and managers who have been employed abroad in a managerial or executive capacity for at least one year in the three years preceding the application. Requires a job offer from a U.S. employer.
🌍 Who Qualifies for the EB-1C Visa?
Employer Qualifications
To sponsor an EB-1C applicant, a U.S. company must establish a qualifying relationship with a foreign entity, such as a parent company, branch, subsidiary, or affiliate. This relationship is typically demonstrated through common ownership and control between the entities.
Additionally, the U.S. company must have been actively conducting business for at least one year prior to filing the petition. "Doing business" refers to the regular, systematic, and continuous provision of goods or services by the company. It's important to note that merely having an office or agent in the United States does not meet this requirement.
Employee (Beneficiary) Qualifications
To qualify for the EB-1C visa, the prospective employee must have been employed outside the United States in a managerial or executive capacity for at least one continuous year within the three years preceding the petition. Additionally, the employee must intend to enter the United States to continue working for the same employer or a subsidiary or affiliate in a managerial or executive capacity.
The role in the U.S. must involve managing the organization, a department, or a component; supervising and controlling the work of other supervisory, professional, or managerial employees; or having the authority to make decisions on behalf of the company.
