New Wage-Weighted H-1B Lottery for 2026: Everything Employers and Candidates Need to Know

The U.S. Department of Homeland Security (DHS) has finalized a major change to the H-1B visa program, officially replacing the traditional random lottery with a wage-weighted selection system. This new rule, published in the Federal Register on December 29, 2025, represents one of the most significant structural shifts in decades.

This new rule will apply to the upcoming H-1B lottery in 2026.

Strategy Shift: The New Wage-Weighted Lottery System

In previous years, H-1B registrations were selected randomly. Under the new rule, wage level becomes the determining factor - the higher the wage level, the greater the likelihood of selection. As a result, H-1B registration is no longer a simple filing exercise, but a strategic process that requires careful planning rather than merely entering employer and beneficiary information.

When you register for the H-1B lottery this year, USCIS will ask for your Job SOC Code, Offered Wage Level, and Intended Employment Location. Since you must later file your H-1B petition with the same data, it is crucial to obtain legal advice early on. A professional immigration lawyer can help you make a smart decision on these variables, maximizing your chance of getting selected.

Below is the estimated selection rate from the H-1B final rule:
