🧑‍💼 TN Visa: For Canadian and Mexican Professionals

 

 

The TN visa is a nonimmigrant U.S. work visa available to qualified Canadian and Mexican citizens under the United States-Mexico-Canada Agreement (USMCA), formerly known as NAFTA. It allows professionals in certain designated occupations to work in the U.S. for a U.S. employer on a temporary basis.

🎯 Key Features of the TN Visa

  • Citizenship Requirement: Available only to Canadian and Mexican citizens.

  • Eligible Professions: Limited to occupations listed in the USMCA (e.g., engineers, architects, accountants, scientists, teachers, computer systems analysts, management consultants, etc.).

  • Job Offer Required: Applicants must have a pre-arranged job offer from a U.S. employer in an eligible profession.

  • Educational Qualifications: Must meet the required qualifications for the specific profession (usually a bachelor’s degree or higher).

  • Apply Within the U.S.: Canadian and Mexican citizens can apply for TN status within the U.S. through a change of status or extension of stay with USCIS.

  • Apply Outside of the U.S.: Canadians can apply directly at a U.S. port of entry with supporting documents (no visa stamp required); Mexicans must apply at a U.S. consulate to obtain a TN visa before entering the U.S.

  • Nonimmigrant Intent Required: TN visa holders must maintain the intent to return home and cannot have dual intent like H-1B holders.

  • Duration: Up to 3 years, with unlimited renewals in 3-year increments.

  • Spouse and Children: Eligible for TD status (cannot work but can study).
